1. Acceptance of Terms

By accessing and using My Prop Journal ("Service", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this service.

My Prop Journal is a software-as-a-service (SaaS) platform designed to help traders track, analyze, and improve their trading performance. By using our service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Service Description

My Prop Journal provides a trading journal and analytics platform. Our service includes:

  • Trade logging and tracking capabilities
  • Performance analytics and reporting
  • Trade plan and strategy management
  • Chartbook and pattern recognition tools
  • Account management for prop trading accounts

3. Not Financial or Trading Advice

IMPORTANT: My Prop Journal is a software technology platform only. We do NOT:

  • Provide financial, investment, or trading advice
  • Offer trading signals or recommendations
  • Guarantee any trading results or performance
  • Provide or manage prop trading accounts
  • Act as a broker, dealer, or financial advisor

All trading decisions are solely your responsibility. Past performance does not guarantee future results. Trading involves substantial risk of loss and is not suitable for all investors.

4. Subscription and Billing

Our service is provided on a subscription basis with the following terms:

  • Billing: Subscriptions are billed on a recurring monthly or annual basis
  • Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless canceled
  • Payment: You must provide valid payment information to maintain active service
  • Price Changes: We reserve the right to modify subscription prices with 30 days notice

5. Cancellation and Refund Policy

NO REFUNDS: All subscription fees are non-refundable. We do not provide refunds or credits for:

  • Partial subscription periods
  • Unused subscription time
  • Account cancellations mid-billing cycle
  • Dissatisfaction with the service

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access until the end of your current billing period
  • You will not be charged for subsequent billing periods
  • Your account data may be retained according to our data retention policy

6. User Accounts

When you create an account with us, you agree to:

  • Provide accurate, complete, and current information
  • Maintain the security of your account password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access
  • Not share your account credentials with others

You are solely responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

7. User Data and Content

You retain ownership of all data you input into the Service. However, you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service to you.

Your Responsibilities:

  • You are responsible for the accuracy of data you input
  • You must not upload malicious code or harmful content
  • You must maintain backup copies of important data
  • You acknowledge that we are not responsible for data loss

8. Intellectual Property

The Service and its original content, features, and functionality are owned by My Prop Journal and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the Service or its content
  • Reverse engineer or attempt to extract source code
  • Remove or alter any proprietary notices
  • Use the Service to build a competitive product
  • Resell or redistribute the Service without authorization

9. Prohibited Uses

You may not use our service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information

10. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Perform scheduled or emergency maintenance
  • Update features and functionality
  • Change technical requirements for using the Service

We will make reasonable efforts to notify users of significant changes or extended downtime.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Non-payment of subscription fees
  • Fraudulent or illegal activity
  • Violation of our Acceptable Use Policy

Upon termination, your right to use the Service will immediately cease. We may delete your account data after a reasonable retention period.

12. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security of data transmission

LIMITATION OF LIABILITY: In no event shall My Prop Journal be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Trading losses or missed opportunities
  • Loss of profits or revenue
  • Loss of data or business interruption
  • Cost of substitute services

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless My Prop Journal, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of your use of the Service, violation of these Terms, or infringement of any rights of another party.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending email notification for significant changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your subscription.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
