Terms of Service

1. Agreement to Terms

By accessing or using My Prop Journal ("Service," "Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Service.

2. Description of Service

My Prop Journal provides a trading journal and performance analytics platform for traders, including:

  • Trade logging and management
  • Performance analytics and reporting
  • Trading plans, strategies, and playbooks
  • Chart books and pattern libraries
  • AI-powered writing tools and coaching features
  • Account management for prop firm and retail accounts
  • A public REST API and Model Context Protocol (MCP) server for programmatic and AI-assistant access to your journal data

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years old to use our Service.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep it updated.

4. Subscription and Payment

4.1 Subscription Plans

We offer multiple subscription tiers:

  • All-Inclusive Plan: 14-day free trial, then full feature access with monthly/annual billing
  • Limited account: Restricted features after trial or subscription ends (no payment required while on limited access)
  • AI Coach Plan: All features plus enhanced AI capabilities

4.2 Billing

  • Subscriptions automatically renew unless canceled before the renewal date
  • Prices are subject to change with 30 days' notice to active subscribers
  • All fees are non-refundable except as required by law

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then, after which your account moves to a limited account with restricted features unless you re-subscribe.

5. AI Features and Limitations

5.1 AI Coach and AI Tools

Our AI features use advanced language models to provide insights, suggestions, and coaching based on your trading journal data.

5.2 AI Limitations

Important: AI-generated content is for informational and educational purposes only:

  • AI responses may contain errors, inaccuracies, or outdated information
  • AI does not provide financial, investment, or trading advice
  • You are solely responsible for verifying AI output and making your own trading decisions
  • We are not liable for losses resulting from reliance on AI features

5.3 AI Usage Limits and Credits

AI features are subject to usage limits based on your subscription tier. The AI Coach plan includes monthly AI usage credits (currently $30 per billing cycle). These monthly credits reset at the start of each billing cycle and do not roll over to the next period.

We always apply your monthly included credits before any purchased credit balance. Excessive use may result in temporary throttling when your available credits are exhausted.

5.4 AI Credit Top-Ups

Subscribers with an active AI Coach subscription may purchase additional AI credits through optional one-time top-ups processed by Stripe. Top-up purchases are separate from your subscription fee.

  • Your monthly included credits are always used first. Purchased credits are only drawn down after your monthly included credits for the current billing cycle are exhausted
  • Unlike your monthly included credits, purchased credits never expire and roll over indefinitely for as long as you maintain an active AI Coach subscription
  • We do not mark up AI credits. The amount you purchase is applied toward third-party AI provider costs
  • Top-up checkout includes a payment processing fee passed through to you to cover Stripe card processing charges (currently estimated at 2.9% + $0.30 for US-issued cards; international cards may incur a higher rate)
  • All top-up purchases are final and non-refundable, including any unused purchased credit balance, except as required by law

Cancellation or downgrade: If you cancel or downgrade from AI Coach, you lose the ability to use your purchased credit balance while you are not subscribed to AI Coach. We do not delete or forfeit that balance on your behalf and we do not issue a refund for it. If you resubscribe to AI Coach, your previously purchased credit balance becomes accessible again.

5.5 Third-Party AI Providers

AI features are powered by third-party providers such as Anthropic (Claude) and OpenAI (ChatGPT). Your use of those services through our platform is also subject to their respective terms and policies. We are not responsible for outages, changes, or actions taken by those providers.

6. API and MCP Access

6.1 API Keys

We provide a public REST API and an MCP (Model Context Protocol) server that allow you, or AI assistants and tools you authorize, to access your journal data programmatically. Access is granted through personal API keys tied to your account and subscription tier. You are responsible for:

  • Keeping your API keys confidential and secure
  • All activity performed using your API keys, including actions taken by any AI assistant or application you connect
  • Revoking any API key immediately if you believe it has been compromised

API and MCP access requires an eligible subscription tier. Access may be rate-limited, throttled, or suspended if your subscription lapses, is downgraded, or if we detect abuse.

6.2 Third-Party AI Assistants (MCP)

The MCP server allows you to connect third-party AI assistants (such as Claude Desktop or Claude.ai) directly to your journal so that they can read and, where you permit, create or modify your data on your behalf. When you authorize such a connection:

  • You are solely responsible for choosing which AI assistants or tools to connect and for reviewing their own terms and privacy practices
  • Any data sent to, or actions taken by, a third-party AI assistant you've connected are governed by that provider's own terms of service and privacy policy, not ours
  • We are not responsible or liable for how a third-party AI assistant interprets your instructions, or for any changes it makes to your journal data once connected
  • You can disconnect a third-party AI assistant or revoke its access at any time by removing the connector or revoking the associated API key

6.3 Acceptable API and MCP Use

Authorized use of the API and MCP server to access your own account data is permitted and encouraged. However, you agree not to:

  • Share, sell, or sublicense your API keys to others
  • Exceed published rate limits or attempt to circumvent usage restrictions
  • Use the API or MCP server to access, scrape, or extract data belonging to other users
  • Build a competing product or service using data or access obtained through the API or MCP server

7. User Conduct and Acceptable Use

You agree not to:

  • Violate any laws or regulations in connection with your use of the Service
  • Share your account with others or create multiple accounts
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal trading activity or market manipulation
  • Upload malicious code, viruses, or harmful content
  • Scrape, data mine, or extract data using automated means without permission (this does not apply to authorized use of your own API keys or MCP connection as described in Section 6)
  • Resell or redistribute our Service or AI features
  • Reverse engineer, decompile, or attempt to extract source code

8. Intellectual Property

8.1 Your Content

You retain ownership of all trading data, notes, and content you input. By using the Service, you grant us a license to:

  • Store, process, and display your content to provide the Service
  • Use your content to power AI features and generate insights
  • Create aggregated, anonymized analytics (not shared publicly)
  • Transmit your content via the API or MCP server to any third-party AI assistant or application you have authorized to connect

8.2 Our Intellectual Property

The Platform, including all software, designs, algorithms, and AI models, is our proprietary property. You may not copy, modify, distribute, or create derivative works.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We take data security seriously and implement industry-standard protections.

10. Service Availability and Modifications

  • We strive for high uptime but do not guarantee uninterrupted service
  • We may modify, suspend, or discontinue features at any time
  • We may perform maintenance with or without notice
  • We are not liable for data loss; you should maintain backups

11. Disclaimers and Warranties

The Service is provided "AS IS" and "AS AVAILABLE." We make no warranties, express or implied, including:

  • Merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of information or AI output
  • Uninterrupted or error-free operation
  • Security of data or systems

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Trading losses, financial damages, or lost profits resulting from use of the Service
  • Indirect, incidental, consequential, or punitive damages
  • Data loss, corruption, or unauthorized access
  • Errors in AI-generated content or insights
  • Actions taken by third-party AI assistants or applications you have connected via the API or MCP server

Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Your trading activities or decisions
  • Your use or misuse of API keys, or actions taken by third-party AI assistants or applications you have authorized

14. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Extended inactivity

Upon termination, your right to use the Service ceases immediately, including any API keys and MCP connections. You may request a data export before account deletion.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for small claims court matters.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or platform notice. Continued use after changes constitutes acceptance.

17. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us
  • Severability: If any provision is invalid, the rest remains enforceable
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not transfer your account; we may assign our rights
